Not being able to prove you employ
competent, well trained employees, can have a negative impact, when
completing pre qualification questionnaires for tenders; providing
evidence in the event of a prosecution, for alleged breaches of
health and safety legislation; or defending a civil claim from an
employee, or their family, following an injury, or fatality at
work.
Competency is an issue, which often
arises during the formulation of an organisation's health and
safety policy, procedures and risk assessments. Competency
can be described as follows:
"a person with practical and
theoretical knowledge as well as sufficient experience of the
particular machinery, plant or procedure involved to enable them to
identify defects or weaknesses during plant and machinery
examinations, and to assess their importance in relation to the
strength and function of that plant and machinery."
The Health and Safety at
Work etc. Act 1974, makes it a legal
requirement to provide training, instruction and appropriate
supervision for employees.
The Management of Health
and Safety at Work Regulations 1999 requires sufficient
competent persons, to assist employers to meet their health and
safety obligations and requirements, as well as ensure their
employees receive specific training and instruction for equipment
and tasks they are undertaking.
The Construction (Design
and Management) Regulations 2015 require the client to
appoint a competent CDM Co-ordinator, to assist them in appointing
a competent Designer and in turn a competent Principle
Contractor. The Principle Contract is then responsible for
appointing competent sub-contractors.
